The 2023 Illinois General Assembly Spring Session is now in full swing with committees set and over 4,000 bills introduced by legislators, with more to come. The LeadingAge Illinois public policy team will be pushing for our Board-approved public policy priorities, while also advocating for member interests by supporting legislation that brings about solutions to provider challenges, while opposing and working to stop bills that place undue burden on member settings. We will send out more information on the LeadingAge Illinois legislation as they are officially introduced. IDPH Assisted Living Rules Update
LeadingAge Illinois will meet with leadership of the Illinois Department of Public Health (IDPH) on Friday to discuss the Assisted Living and Shared Housing Act rules that have been opened by the Department with their proposed changes. The opening comes on the heels of LeadingAge Illinois Assisted Living Cabinet wrapping up months of meetings and discussions to revise the rules. The meetings have included legal counsel.

LeadingAge Illinois presented the recommended revisions to the Department recently and the Friday meeting has been set to discuss the two proposals. Some of our primary concerns with the Department’s proposal are:
• The tripling of fees and fines during a time in which providers are still trying to recover from the challenges brought on by the COVID pandemic.
• Elimination of the provider’s opportunity to present a statement of dispute.
• Concerning language added to the incident and accident reporting section.

In addition to the meeting and communications with IDPH, LeadingAge Illinois will be submitting official comments on the IDPH proposed rules by the 45-day deadline. The rules were proposed on January 13, 2023.

Impending Deadlines
Each week, we will keep you abreast of important deadlines.
• February 21: Final Opportunity for Providers to Request Reconsideration of Phase 4 and ARP Rural Payments: HRSA is working swiftly to wrap up all PRF and ARP Rural payments to providers. Therefore, providers who believe their Phase 4 and/or ARP Rural payment was calculated incorrectly have one last chance to submit a payment reconsideration request by February 21, 2023 at 10:59 p.m. CST. All providers have had at least 45 days from the date of their Phase 4 and/or ARP Rural payment determination notification to submit a reconsideration request. Housing:
HUD Posts Round V COVID-19 Supplemental Payments (CSP) Request Form
On February 6, HUD posted the updated request form for Multifamily Housing providers to request CSPs from HUD during Round V. Eligible HUD-assisted housing providers can use the form to request reimbursement for certain COVID-related expenses completed by January 31, 2023. The request deadline is February 21, 2023.
